My cat has been found alive and the people who found him won't give him back what do I do?

my cat was found by a person who granted saved his life but after finding out he was not abandoned and well loved by us she still won't give him back we are heart broken and does anyone have advice to quicken up our course of action....we are going to small claims but need help to win our case!! please and thank you
